We are always committed to keeping your privacy protected and your information confidential. This Privacy Policy, “policy” and “policies”, describes how we collect, use, and disclose personal information.
In this policy, “we”, “our”, “us”, and “MortgagePro” mean MortgagePro Ltd. and its affiliates; “you” and “your” mean an individual who has made, submitted, enrolled, or signed an application in respect of any personal or business banking, insurance, brokerage or financial product or service offered by us “service”, including any co-applicants, guarantors or personal representatives.
- CONSENT, SERVICES, AND NATURE OF COLLECTION
1.1 We collect, use, and disclose your personal information with your consent (which may be express or implied) or as required or permitted by law. By voluntarily providing us with your personal information (whether through our websites or otherwise), you consent to our collection, use and disclosure of that personal information in accordance with this policy. Subject to legal and contractual requirements and upon reasonable notice, you may withdraw your consent to our further collection, use and disclosure of your personal information by contacting our privacy officer below. If you refuse or withdraw consent, we may be unable to provide you with certain products, services or information.
1.2 We will collect your personal information, directly from you or from interactions with you, to determine your identity and credit eligibility. Your personal information includes:
- Your name, address, telephone number, nature of your principal business or occupation and date of birth, which is required by law
- Identification, such as a valid driver’s license or passport. We may also ask for documents such as a recent utility bill to verify your name and address
- Your income, assets, liabilities, and credit history
- Information about your transactions, including payment history, account activity and how you intend to use the account or Service and the source of any incoming funds or assets
- Information we may need in order to provide you with a Service such as health information if you are applying for certain insurance products. In some instances, providing this information is optional
- Information about third parties such as your spouse if you are applying for certain Services, where this information is required by law
- Information about beneficial owners, intermediaries and other parties, which is required by law
- For legal entities such as businesses, partnerships, trusts, estates, clubs or other organizations, we may collect the information referred to above from each authorized person, partner, trustee, executor and club member, as appropriate.
1.3 We limit our collection of your personal information to the information that is necessary to fulfill the purposes we identify to you or as otherwise required or permitted by law.
1.4 We will submit your financing application and other documentation to the lender.
- DISCLOSURE OF PERSONAL AND CONFIDENTIAL INFORMATION
2.1 You give your consent to us to collect, maintain, use, and disclose your personal information for the purpose of all uses consistent with arranging and/or renewing loans, mortgages or other financing.
2.2 You agree, we will collect your personal information from any person or source that has personal information about you. You authorize them to release your personal information to us.
2.3 You agree we can provide your personal information and financing application to each potential lender, insurer, insurance agent/broker or service provider, and they may receive this information maintain records relating to you, including your Social Insurance Number if you provide it.
2.4 You agree, each potential lender, and we can verify any information from any source for the purposes of arranging and/or renewing loans, mortgages or other financing.
2.5 You agree we will retain your personal information for safe keeping in accordance with the Real Estate Act of Alberta and the Mortgage Brokers Act of British Columbia or any other jurisdiction, the Personal Information Protection Act (PIPA) and the Personal Information Protection and Electronic Documents Act (PIPEDA), whether or not your financing is approved or funded. You agree, we may send the application and personal information to a corporate office of the brokerage and hold the information securely with access restricted to individuals having a need to deal with the information.
2.6 We will not:
a) give out any of your confidential information without your consent, unless required by law.
b) use confidential information we receive from you or that we get from performing under an agreement for any other purpose than those in the agreement unless you agree in writing.
2.7 Our duty is to keep your information confidential.
2.8 You understand the use of the information is to determine your credit eligibility.
2.9 You agree we may advise any party involved in the transaction about the progress of your application.
2.10 Any personal information may also be transferred or disclosed to a purchaser or prospective purchaser in the event of a sale, assignment, or other transfer of all or a portion of our business or assets. Should such a transfer occur, we will use reasonable efforts to try to ensure that the transferee uses your information in a manner that is consistent with this Privacy Policy.
- OUR RESPONSILBITIES
3.1 We will review your personal information and documents received to confirm your identity and your credit eligibility. If further verification is required, we will notify all parties to any contemplated transaction of any changes.
3.2 We may provide related financial services.
3.3 We will only represent the lender, you, or act as an intermediary between you and lender(s).

- advocate on your behalf
- provide confidential advice
- be honest
- exercise reasonable care and skill
- gather your intended property and financial information to determine the lending options available to you
- disclose and explain appropriate finance options for your consideration
- complete and submit documentation to the lender
- keep you informed of the progress of your application
- b) Our responsibilities to the lender include:

- YOUR RESPONSIBLITIES
4.1 Communicate and cooperate with us.
4.2 Be honest.
4.3 Give us personal and financial information and keep us updated on any changes.
4.4 Pay all applicable expenses for a credit report, appraisal, Alberta Registries report and courier charges for this purpose of an agreement whether or not you receive approval or funding. We will discuss these expenses with you.
4.5 Pay for any costs we incur to verify your personal information.
- CREDIT BUREAU CONSENT
5.1 You authorize us to obtain credit report(s) from Equifax, TransUnion or any other authorized providers.
- OUR FEE
6.1 We will receive our fee for this mortgage transaction from the lender.
6.2 We may (will) also receive monies or non-monetary benefits from the lender that include additional fees based on our volume of business with the lender, our efficiency with the lender, because you are paying a higher rate than otherwise is available with this particular lender, travel/gifts, attendance at seminars or conferences, equity shares with the lender, and fees charged by the lender for lending fees and renewal fees.
- ONLINE MARKETING
7.1 When you visit our websites, apply for, enrol in or use a service, or participate in any contest, survey or event via a digital channel (such as on a website or through Social Media), we may collect information about your computer or device, operating system, internet connection or telephone account, settings, IP address and device locational data, browser information, and transaction data, as well as personal information as described above. We may collect, use, disclose and retain this information.
7.2 MortgagePro or its service providers may also use various web tools including Cookies, Web Beacons, and Tagging on our websites and advertisements to evaluate and improve our websites and other electronic offerings, tailor our services, enhance our customer experience and communicate with you regarding products and services that may be of interest.
- CHANGES
8.1 This Policy is effective December 1, 2020 and remains in effect until amended.
8.2 MortgagePro reserves the right to amend this Policy at its sole discretion without notice to you.
8.3 We recommend that you review this policy frequently to obtain the current version, and to ensure that you are aware of and accept any changes made.
- RETENTION AND ACCESS
9.1 Personal information will be retained only as long as necessary for the fulfilment of the purposes for which it was collected and for which consent was received or to satisfy legal requirements.
9.2 If you wish to access or correct your personal information in our custody or control or ask a question or make a complaint about our personal information practices under this policy, please contact the Privacy Officer below.
- INFORMATION MAY BE LOCATED OUTSIDE OF CANADA
10.1 In some cases, personal information that we manage may be transferred, processed and stored outside Canada, and therefore may be available to government authorities under lawful orders and laws applicable there.
- COMPLIANCE WITH CANADIAN ANTI-SPAM LEGISLATION
11.1 Canada’s new Anti-Spam Legislation (CASL) came into effect on July 1, 2014. Under this new legislation, we are required to obtain your consent in order to send you email communication about latest mortgage news, events, products and services.
- SAFEGAURDS
12.1 We protect your personal information in our custody and control from loss, misuse, unauthorized access and alteration by using reasonable physical, organizational and technological security measures.
12.2 To the extent we have arrangements with service providers to store or process personal information on our behalf, our policy is to require them by contractual or other means to provide comparable protection while the information is stored or processed by them. However, these service providers may have privacy policies of their own.
12.3 While we believe these safeguards are reasonable and are comparable to the safeguard provided by providers of similar services, we cannot guarantee that they will be sufficient to protect the privacy and security of your personal information in all circumstances.
- LEGAL
13.1 We and our service providers may disclose your personal information in response to a search warrant, subpoena or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by applicable law. We may also disclose personal information where necessary for the establishment, exercise or defense of legal claims, or as otherwise permitted by law.

The brokerage must provide this agreement upon you are engaging into a relationship with them to clarify their duty and your rights.This will help identify any compensation that will be awarded to the Brokerage and from what source. It ensures they will be compensated in agreement with you.
